TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of loka.haus (the "Site") and any purchases made through it. The Site is operated by LOKA HAUS LLC, a Texas single-member limited liability company ("LOKA.HAUS," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms in full.
1. USE OF THE SITE
You must be at least 18 years of age to use this Site or place an order. By using the Site, you represent that you are at least 18 years of age and have the legal authority to enter into these Terms.
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You may not use the Site to transmit any material that is unlawful, harmful, defamatory, or otherwise objectionable, or to interfere with the operation of the Site.
We reserve the right to refuse service, cancel orders, or terminate accounts at our sole discretion.
2. PRODUCT DESCRIPTIONS & IMAGERY
We make reasonable efforts to describe and represent our products accurately. However, you acknowledge and agree to the following:
2.1 Natural material variation. LOKA.HAUS products are made in small batches using deadstock and natural fiber materials. Natural variation in fabric drape, color saturation, and surface texture is inherent to these materials and is not a product defect. The finished piece you receive may differ slightly from product photography in these respects.
2.2 Hand-cast hardware variation. All LOKA.HAUS brass hardware is cast by hand using a cold-cast resin and brass powder process. Each piece is unique. The patina, surface texture, and precise form of the hardware on your garment will vary from piece to piece and from any photography shown on the Site. This variation is a characteristic of the hand-made process and is not a defect.
2.3 Use of AI-rendered imagery. LOKA.HAUS uses AI-generated renders to represent products that are in development and not yet available as finished, photographed pieces. We are committed to representing our products as accurately as possible in all imagery, including AI renders. AI renders are generated from detailed construction and materials specifications and are intended to reflect the planned design as closely as current rendering technology permits.
Where AI-rendered imagery is used, it will be identified on the relevant product listing or page with language such as "Design direction render — not final product photography" or equivalent disclosure. We do not use AI renders to represent products that are available for immediate purchase without such disclosure. When finished product photography becomes available, AI renders will be replaced.
By placing an order on any product whose listing includes AI-rendered imagery, you acknowledge that the imagery is a design direction render and not a photograph of the finished piece, and that reasonable variation between the render and the finished product is expected and accepted.
2.4 Colors. We make reasonable efforts to display product colors accurately. However, color representation varies across monitors, devices, and display settings. We cannot guarantee that what you see on your screen exactly matches the color of the physical product.
2.5 Preview listings. Certain products on the Site may be listed as "in development," "coming soon," or "preview" with no Add to Cart functionality. These listings are informational only. No purchase, reservation, or contractual obligation is created by viewing or joining a waitlist for a preview listing.
3. PRICING
All prices are listed in US Dollars (USD) unless otherwise indicated. We reserve the right to change prices at any time without notice prior to your order being placed. Prices in effect at the time your order is confirmed are the prices that apply to your order.
We are not responsible for pricing errors. If a product is listed at an incorrect price due to typographical error or system error, we reserve the right to cancel any orders placed at the incorrect price and notify you prior to fulfillment.
Applicable taxes are calculated at checkout based on your shipping address. International orders may be subject to import duties, customs fees, or local taxes imposed by the destination country. These fees are the responsibility of the buyer and are not included in our pricing or shipping charges.
4. ORDERS & PAYMENT
By placing an order, you represent that the information you provide is accurate and that you are authorized to use the payment method provided.
Orders are not confirmed until you receive an order confirmation email from us. We reserve the right to cancel any order at our discretion, including but not limited to cases of suspected fraud, errors in pricing or availability, or inability to process payment.
Payment is processed at the time of order. We accept major credit cards and any payment methods displayed at checkout. Payment processing is handled by Shopify Payments or Stripe. We do not store your full payment card information.
5. MADE-TO-ORDER POLICY
Made-to-order pieces are produced specifically for you after your order is confirmed. Made-to-order orders require upfront payment. Made-to-order pieces are final sale and are not eligible for return or exchange except in the case of a manufacturing defect. Timeline and specifications will be confirmed in writing before production begins.
6. SHIPPING & DELIVERY
We ship from Austin, Texas. We make reasonable efforts to ship in-stock orders within 3–5 business days of order confirmation. Delivery timelines are estimates and are not guaranteed.
Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for delays caused by the carrier, weather events, customs clearance, or other circumstances outside our control.
International buyers are responsible for all import duties, taxes, and customs fees applicable in their country. We are not responsible for items held, delayed, or confiscated by customs.
If a package is returned to us due to an incorrect shipping address provided by you, we will contact you to arrange re-shipment at your cost.
7. RETURNS & EXCHANGES
7.1 Eligible returns. Items in original, unworn, unwashed condition with tags attached may be returned within 14 days of delivery for a refund to the original payment method, less original shipping costs. Return shipping is the responsibility of the buyer unless the return is due to a manufacturing defect or our error.
7.2 Non-returnable items. The following items are final sale and not eligible for return or exchange: made-to-order pieces, sale items marked final sale, jewelry (for hygiene reasons), and any item that has been worn, washed, altered, or damaged after delivery.
7.3 Defects. If you receive a product with a manufacturing defect, contact info@loka.haus within 7 days of delivery with photographs of the defect. We will arrange a replacement or full refund at no cost to you, including return shipping.
7.4 Process. To initiate a return, email info@loka.haus with your order number and reason for return. Do not send items back without first receiving written return authorization. Items returned without authorization may not be accepted.
8. INTELLECTUAL PROPERTY
All content on the Site — including but not limited to text, product descriptions, photography, AI-rendered imagery, brand assets, logo, and design — is the property of LOKA HAUS LLC or is used with permission, and is protected by applicable copyright, trademark, and intellectual property laws.
Regarding AI-generated imagery specifically: LOKA.HAUS asserts creative authorship over all AI-rendered images produced using our detailed proprietary design briefs and prompts. The creative direction, construction specifications, material descriptions, and stylistic parameters embodied in our prompts represent substantial human creative contribution to these works.
You may not reproduce, distribute, publicly display, modify, or create derivative works from any Site content without our express written permission. Unauthorized use of our content, including AI renders, photography, or copy, will be pursued to the full extent available under applicable law.
9. USER CONTENT
If you submit reviews, photographs, or other content to the Site or tag LOKA.HAUS on social media, you grant LOKA HAUS LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content for marketing and promotional purposes, with credit where practical. You represent that you own or have the right to submit any content you provide.
10. PRIVACY
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in our Privacy Policy.
11. DISCLAIMER OF WARRANTIES
The Site and its content are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, LOKA HAUS LLC and its members, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products, even if advised of the possibility of such damages. Our total liability for any claim arising out of a purchase shall not exceed the amount paid by you for the product at issue.
Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
13. INDEMNIFICATION
You agree to indemnify and hold harmless LOKA HAUS LLC and its members, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third-party rights.
14. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved in the state or federal courts located in Bexar County, Texas, and you consent to the personal jurisdiction of those courts.
Before initiating any legal proceeding, you agree to contact us at info@loka.haus and give us 30 days to attempt resolution in good faith.
15. CHANGES TO THESE TERMS
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
